The term "Distinctly Living" or "us" or "we" refers to the owner of the website whose registered office is 35 Lower Street, Dartmouth, Devon. TQ6 9AN. "Distinctly Living LTD" is LTD company.

1. Eligibility

You must be at least 18 years old to place an order on this website. By ordering, you confirm that you have the legal capacity to enter into a contract.

2. Products

All products are subject to availability. We reserve the right to withdraw or amend products without notice.

Product images are for illustration purposes only. While we make every effort to display colours and descriptions accurately, we cannot guarantee that your device will reflect them precisely.

3. Prices

All prices are shown in GBP (£) and include VAT unless stated otherwise.

Delivery charges are shown separately and added at checkout.

We take reasonable care to ensure prices are correct, but if a pricing error is identified, we will contact you before processing the order or cancel the order and issue a full refund.

4. Orders and Contract Formation

When you place an order, you are making an offer to purchase goods. A legally binding contract is formed only when we send you an order confirmation email.

We reserve the right to refuse or cancel any order, including where:

Payment is not authorised

There is a pricing or description error

The product is unavailable

5. Payment

We accept payment via [list payment methods, e.g. debit card, credit card, PayPal].

Payment must be received in full before goods are dispatched.

6. Delivery

We deliver to UK mainland only by default unless agreed in writing.

Delivery times are estimates and not guaranteed. We are not responsible for delays outside our control, including courier delays or force majeure events.

Risk of loss passes to you when goods are delivered to your nominated address.

7. Consumer Right to Cancel (Distance Selling)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods, without giving any reason.

To cancel, you must notify us in writing (email is sufficient) within the 14-day period.

You then have a further 14 days to return the goods.

8. Returns and Refunds

Returned items must:

Be unused and in resaleable condition

Be returned in original packaging where possible

You are responsible for return postage costs unless the item is faulty or incorrect.

Refunds will be issued within 14 days of receiving the returned goods, using the original payment method.

9. Faulty or Incorrect Goods

Under the Consumer Rights Act 2015, goods must be as described, fit for purpose, and of satisfactory quality.

If goods are faulty:

Within 30 days, you are entitled to a full refund

After 30 days, you may be entitled to a repair or replacement

This does not affect your statutory rights.

10. Exclusions to the Right to Return

The right to cancel does not apply to:

Personalised or custom-made items

Sealed goods that are not suitable for return for health or hygiene reasons if unsealed

11. Intellectual Property

All content on this website, including text, images, logos, and designs, is our property or licensed to us. You may not copy, reproduce, or distribute any content without our written permission.

12. Liability

Nothing in these Terms limits or excludes our liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation

Any matter where liability cannot be excluded under UK law

Otherwise, our liability is limited to the purchase price of the goods.

13. Privacy

Your personal data is handled in accordance with our Privacy Policy and UK GDPR requirements.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms from time to time. The version in force at the time of your order will apply.
